Special prerogative for Non-Muslims in their Personal law
As regards Personal law however, non Muslims will not be forced to be governed by the Islamic Jurisprudence. All laws for marriage, divorce, inheritance and related matters will not be interfered with by the Muslims. If pork, alcoholic drinks, marriages regardless of consanguinity…etc. is lawful in their religion then they will not be prohibited from them.
The righteous Caliphs had delegated many temporal judicial powers to Christian priests. During the Abbasid Caliphate, the Christian Patriarch as well as the Jewish Rabi and The Hakham were considered to be the highest dignitaries of the Muslim state and the Caliph used to consult them in the affairs of their respective communities.
The Jews in Medina had set up their own religious and educational institution called Bait al-Midras during the time of the prophet, peace and blessings be upon him. The Jewish and Christian institutions were left to their communities to manage their affairs during the Umayyid and Abbasid Caliphates. Muslims, Jews, Christians and Magians had conserved their modes of dressing and social customs.
